So, while taking a lunch break, I hear on Fox News (yeah, I had unmuted the TV) that Michael Newdow was successful in declaring "under God" unconsitutional again at a state area level.  While an earlier case was dismissed by the US Supreme Court, a few parents and their kids have hired him to file this new lawsuit.  The local federal judge ruled that "under God" in the Pledge of Alegence was unconsitutional for the same reasons the 9th Circuit Court in California said in the previous case -- kids are essentially forced to recognize God irrespective of the religion (even if they call God "Zuul" or don't recognze such a deity at all), and that voilates the concept of seperation of church and state (an extention of the First Amendment).

You know this is going to be appealed to the 9th Circuit.  Newdow's got a case he can hang on to.  I hope he wins when it eventually gets to the Supreme Court.

The previous case was dismissed on a technicality, right? Something about the plaintiff not having the legal ability to sue on behalf of the kid in question?

Let's hope this one goes better.
